Officers visual observations of running lights and signs, bad driving is evidence.
What would stick out of these 5 tickets who knows.
Now any video will complicate a defense of no evidence.
If no radar or laser then speed offense comes into question, but a video may be enough to convict, but at a lesser charge.
It keeps repeating, lawyer up.
Virginia has a similar code, reckless driving generally. It's basically a "catch all" for anything an officer feels could be considered reckless driving, or if he just wants to stick it you. Many times though RD-generally will get reduced to improper driving, a lesser violation but still involves going to court, usually with a lawyer so you're still paying one way or another.

Their notes of observations is entered as evidence.
Their verbal presentation to the judge is the testimony.
I've sat there and had a LEO yelling at me that he was a qualified visual estimator of speed, cited his training and such.
My questioning of him blew him out of the water and I got off.
My RD helped pinpoint the time he pulled out on the highway and turned it on.
He was honest to a fault, mad as he was, he admitted radar recorded PSL by the time he shot.
Judge still believed the officer and gave me the speach, then dismissed the case.

In theory, it's possible to calculate speed by eye, but that's very inaccurate and surely not enough to issue speeding ticket. Not so sure about USA thought.

Cops are allowed to offer opinions on speed with weight and credibility being for the trier of fact. It’s enough for a prima facie case.

Been there twice....
Got lucky in court twice....

In every US jurisdiction, pigs can offer opinions on speed, and in most, under the lay opinion rule, so can laymen.

Yes velocity is space divided by time, so it's possible to calculate speed by counting time that vehicle takes to pass, say, 100 meters. But unless you are doing twice a speed limit, it's very hard to estimate real speed. I understand that some cops don't care about it, they don't respect justice and want to feel important.

End up getting pulled over this morning and the cop gave me 5 tickets. I did not see him when I got on the highway nor did I see him get off the highway when I did. He said I was doing 80mph in a 55mph and ran a red light when I got off the highway.
This is my own fault and I’ll have to hire a lawyer to fight this because each ticket comes with points. My dashcam was not running because I had to get a new windshield put in a few days ago and didn’t reconnect it. View attachment 130162View attachment 130163
1. Speeding but no way to verify speed accurately
2. Ran a red light
3. Ran a stop line that's usually a touch before the signal or sign
4. This is a new one on me - is it for special intersections, stop sign just over the crest of a hill, special crossing???
5. Blew a light in a right turn on red state

To me you should get 1 and 5, not all five, assuming you were speeding and ran the light on a turn.

However, we are talking about PG so I wouldn't be surprised if the footage gets "lost". It's not exactly a PD that's well known for honesty and integrity:rolleyes:.
If that actually occurs, depending on the wording of the request, that is ammo for the lawyer. Open Records Laws are pretty specific.

My r7 and alp did not go off. On the ticket there no speed listed nor did he check the box on how he got my speed.
He may be rusty at VASCAR and used the catch-all ticket to cite you. In WI, they have a related ticket and that is Too Fast for Conditions. You can be cited this one doing under the PSL, and also for doing the minimum PSL. I.E. it's raining etc.

Come to NY and the rules are a little bit different,. They can give an actual visual speed and it can stick - or they can give a lsmall range - like 50-55 and it will will most likely also stick.

As long as the officer testifies he received the proper training and visually verified you speeding, it's extremely difficult to challenge the actual speed they stated here in NY.

They can also do it with no other traffic around, just one car viewed is enough.

If the NY LEOS follow those simple rules stating they viewed the speeding vehicle and they have been properly trained, we cannot even challenge the certification of the radar gun here, visual is enough to get you found responsible and even if they did use Radar, they don't have to mention it.

Nevertheless, it is possible to convict on the basis of the reading of an untested radar device, if some other form of corroboration has been provided (People v. Magri, 2 NY2d 562, 567 [1958]). A trained officer's visual estimation of a vehicle's speed is sufficient, either standing alone or in conjunction with other evidence, to sustain a speeding conviction (see e.g., People v. Susana, 29 Misc 3d 144[A] [App. Term, 9th & 10th Jud. Dists. 2012]). The opinion evidence of police officers uncorroborated by mechanical devices is sufficient to sustain a speeding conviction (People v Olsen, 22 NY2d 230 [1968]

This kinda thing happens all the time where I am. You'll get done for speeding, then they might throw on either reckless driving, driving without due care, improper use of a road and all the minor technicalities associated, you name it. There would be a drug and alcohol test thrown in as a bonus round to see if they can get anything extra.
If they can, they will point out your tyres for lack of tread if possible, so then they attempt to lock the car down for being unroadworth, pick on a minor cracked windscreen as a hazard, or broken mirror, noisy exhaust. Cop usually likes to pin 3 things at least, to strengthen the ticket, but basically it's all in the same charge in case it goes to court, so it looks worse than it is. I'm sure the judges know the game well and so do lawyers. It's a pile on scare tactic, but play the legal game with a lawyer who knows the rules well, and you should be OK. Unfortunately it costs money, and once in this situation, whether you pay the fine or take it to court, someone's getting paid along the way and we have to accept that. The systems stitched up pretty good isn't it!? No free lunches in this predicament either way you look at it and they make the exit door via your wallet usually. You used to be able to opt for community service if you could claim financial hardship, but they stopped this where I am. Incredible! No profit in it I guess. Cash all the way!

The courts within the State of Maryland are generally lenient with Maryland residents with regards to traffic infractions. The courts generally give Maryland State residents "Probation Before Judgement." But, if you don't reside within the State of Maryland, and you get a traffic violation, get a lawyer and say a prayer and hope that the judge will reduce the charges to a lesser offense.

For sure. All the university graduates need an avenue of employment. Law is a good one constantly active 24/7 and in effect in our daily lives. If you can put up with the wording and take in a massive volume of information, you're halfway there picking out the fine points in defence or prosecution.
I got lucky recently to link up with a new lawyer I met at my old work. He's in his 20's I'd say, specialises in traffic law, and bonus that he kinda looks a bit like a young Jeremy Clarkson. At the time I met with him, he'd got 5 people off traffic charges with no conviction in one month. So I said "Give me your business card" Haha! I'll be happy to support the legal sector at some stage. Preferably not in prison.

As a retired lawyer representing medical device manufacturers in death and personal injury claims arising from defective devices, I agree. I especially agree every time I get a bank statement.

Quick update. I got the 5 tickets September 11. They received my request for a court date on September 16. They still haven’t assigned me a court date. They told me to call back in a few weeks to see if they finally assigned one. I also retained a lawyer to handle this case for me.

Aren't they supposed to assign a court date at your arraignment, if you plead not guilty?
