Yea I read it twice, seems a very odd article- as in I'm sure there is more to the story.

That's always been crazy here - you might need to overtake a road train that can be upto 53.5 m (175') long, but you need to stay within the speed limit while overtaking into oncoming traffic.

I'm sure its safer to floor it, and get past asap, then get back down to a safer speed

No, the Judge didn't say it's legal to speed while overtaking, he said that the circumstances of that case made it unreasonable for a conviction to be entered. A little bit like the self defence provisions in law.
It is a good, common sense precedent though. I bet the Crown will appeal.

I'll just continue to do what I've always done, overtake as quickly and safely as possible.

PS. Once upon a time Traffic Cops used discretion in those cases, but that was when they had humans writing tickets, not automatons.

PPS. Wouldn't it be nice if the cops targeted the scum that boot it when you start to pass them. I'm sure there are a significant number of crashes caused by them.
A few plain cars would do it. Word would get around.
This is one reason I bought a car that they can't out-accelerate. I'm past before their POS even kicks down.

This is exactly why the EU's incoming laws around GPS enforced speedlimiters in all cars is downright dangerous:
EU ruling means speed limiters will be mandatory in the UK by 2022 | RAC Drive

I heard Julie Anne Genter in an interview on Newstalkzb a couple of weeks back comment that she was watching the EU idea, and she though it 'had merit' to consider for here.
Just crazy stuff.

That system has an override for overtaking, and can be disabled. Ms Genter is so incompetent in her role that she doesn't realise it won't be usable here in EU form.
That's because the round white sign with a black diagonal on it that means 100 limit here, means unlimited in Germany.
