NC speeding ticket

So my GF son is active military in NC. He called her yesterday saying that he got a speeding ticket and has a mandatory court date. I assume that means it was excessive speed he would not admit how fast he was going. He’s 24 and I don’t think he has any active points on his license. Any North Carolina peeps have any advice? With a mandatory court date is should he have a lawyer?

I'm from NC and you have no choice! Hire a lawyer that is from the area that knows the d.a. and judge from the county where the courthouse is. Hopefully he can make it go away without having to go to court, even though you have a mandatory court date. NC traffic court is brutal, ask me how I know!

  • A speeding ticket for driving over 15 mph over the posted speed limit or over 80 mph is a Class 3 misdemeanor.

He'll have it dropped to improper equipment unless he was 26 or more over
He is then ineligible for improper equipment 0 points
Usually you have to eat 3 dmv points at 26 over but get it reduced to 9 over non points
Most DAs want +14 so no license suspension but 3 dmv points and 3 insurance points
MAKE sure lawyer is from county ticket was issued
City/county much better reduction chance than trooper

I'll add, that he will probably have to take the alive at 25 class.

It's going to depend on how fast. If it's 100+, his chances (depending on the county) get a little tougher. But, if his record is clean and he gets a lawyer in the same county. They will most likely drop it down. Take the class and with the lawyer, he won't have to even be there.

This is the charge I was facing when I got caught in July, 2017. This was in Wake County. 13 lawyers told me I'm screwed, so I hired a very affordable one who lived 5 minutes from me. He was very honest about what was going to happen to my license and points wise too. This was a reckless driving charge with a 60 days license suspension and 6 license points + a fine.

I succeeded to show the DA I had a clean record, a house, a job etc etc. and I wasn't some punk who landed in Wake County. I also had a clean driving record. The charge was lowered to an infraction, 3 points and a $200 fine. (No reckless, no suspension)

I did suggest to him I had a clean record in California, and this is what I will suggest to you and your son as well.

Print off the driving record and talk to a traffic lawyer, he should be able to talk to the Assistant DA and reduce the charge.

Tell your son not to mess around in NC, they don't play games here.

ok little more info, 23 over and no work zone. he has lawyered up and is meeting with them today

23 over, he should be able to use the Prayer for Judgement or at least they will drop it to 13 or 14 over and a few points, not the end of the world. I couldn't use the PFJ since I went stepped into the "You are going to hell" zone, which is 30 over.

This wasn't in Wake County wasn't it?

I doubt much help or success for $50-100 NO MORE. I'd guess about $300 to make it go away. He could probably get it reduced to less than 15 over. Lived in NC all my life and driven for 45 and spent the night in jail many years ago for 18 over (stupid young, and with an attitude), In NC they can lock you up or, take your license on the spot for 16 over psl. Or at least used to be that way.
