Say's that he had to go over 100 mph to catch up to me but it's just cause I was ahead of him already....

So then what would you guys say is the best way of dealing with this?
Go to court and poke holes in the cops bullshit. If that doesn't work for some reason, submit Dashcam video to at least get it reduced from 90 or try to show the cop doesn't know what he's doing?
Call out the cops BS upfront saying that the information on the ticket has been falsified and thus should be negated. Dashcam footage would show the OP speeding since he was over the PSL no matter what but he has to make his point that the ticket is a lie regarding the speed. The footage can also show how he was traveling through traffic, etc

Maybe but he'll have to submit an unaltered SD card. I've never had the balls to submit any of mine.

"He'll see my video and you guys can fight it out." That is one of the dumber things I have heard a cop say, the fight won't be with the judge.

Would be fun having him explain why he couldn't put an exact speed while "pacing."

Yeah,
Talk to a lawyer. It seems to me that a lawyer ought to be able to make most of this go away. The lawyer would know best how to use your footage and that of the officer's dash cam. Who knows, he may have even gotten confused and was initially after a different vehicle.

So should op remove the SD card from his camera and put it somewhere safe, using a new SD card until his court date?
If he wants to use it as evidence he should. If he used it enough so it wrote over the period of his violation but the stop remained it would look very odd. Probably not prosecutable but odd.

First, what jurisdiction and what kind of LEO (local or GHP)?

Second have the ticket moved to state court to remove home field advantage.

Third, it is time to call his bluff if you’re actual dash cam proves you were never even at 90. Don’t let them know you have a dash cam. Request discovery and get an actual copy of his dash cam video. Then if as you say your video shows you never near 90, in court walk the officer into stating you were over 100 and he only wrote you for 90. Then when your turn to submit evidence your evidence shows the LEO perjured himself and we can get a lying revenue cop off the street and you get out of a ticket!

To bad my Florida Attorney retired, he would have loved this case, tied the officer up in court for a couple years, got you out of your ticket, and at a minimum got the officer fired if not jailed on perjury! In fact, I might call Stuart this weekend to see if he is interested in some fun.

yeah GA400 (atleast thats what it looks like and judging by sandy springs pd) is a speedway ive done 90 on that easy with flow of traffic and then suddenly it will slow down to a crawl. So.... i dont know where that cop is from but the way he pronounces "court" is extremely annoying.

The black tail light and license frame deal is to make you think he is letting you off easy. another dont take this to court deal.

Yeah, when I lived in Atlanta I had a cavalier attitude about speeding. I drove like a nut everywhere 20 to 40 over PSL. Then one day I see brake lights up ahead and slow down to what I thought was reasonable 65 in a 60 and GSP lights me up. 5 over PSL. I ordered my ZR3 that night.

if i traveled that more often i would be more serious about a laser jammer but now my drive is 7 miles of congestion so i dont even have an opportunity to speed on my daily drive.

Says who? Why couldn’t he take the relevant snippet of footage, burn it to DVD, and present that to the court? I don’t know of any legal reasoning that says you have to turn over all footage that you own to the prosecutors, when the rest of the footage is not relevant to the case. You as the defendant can submit whatever you feel like. If the prosecution wants more, they need to get a warrant and explain to the judge why it’s paramount to the investigation.

Speeds close to 90mph is the key word here. This is really going to annoy me. I didn't even know the PSL was 55 on the highway right there. Speed signs don't even work as you can see from the video I linked(most of all the speed signs that light up don't work). I know that won't hold up anyway but it's very annoying. I was still in the left lane keeping up with the flow in front of me which was over PSL I was just the one in the back with no one else behind me so I guess he wanted to "pace" me which obviously he didn't do successfully. Again from my rear dash cam footage he just sped so fast obviously over 100mph like he said he had to do to catch me. He was only behind me for about 5-8 seconds. He caught up so fast

What you say is true in Utah for the most part.....at the Fire Department we have been warned by our City Attorney that if we choose to use our personal phones to take video or photos on scenes, not only can they subpoena the applicable media, but they can in fact request access to the entire phone to check for additional media that we didn't volunteer.....they said it's a legal part of the discovery process. They said that we could motion to suppress, but then it comes down to the judge as his feelings. I guess that there isn't any real solid answer on this yet....it's all still open to judicial interpretation.

As usual, the devil is in the details.

Is this on the variable section of I-285?

If so, I don’t believe Sandy Springs has a permit submitted to enforce that section. If they do, I’m betting it had 65 on the cert which means they can’t do traffic speed enforcement.

Additional is your actual speed listed on the citation anywhere? If not he didn’t pace you!

If you feel you can test me Logan, PM me a copy of the ticket (feel free to black out DL address and such) as I just need the info and citation number and I’ll call Carlos tomorrow to see what he thinks.
