What would you do if you jam LIDAR, the cop doesn't get a reading, but claims he did and tickets you anyways?

So this is a peculiar situation I think may be extremely rare, but I'd like to ask to all of you here; what would you do?

So I know in some states they require the LEO to put what method they used to get the speed and issue the ticket. Well, if they got their gun jammed, you slowed down, and this pissed them off and they wrote a ticket claiming they had your speed anyways, what would be your defense?

I would get a lawyer and put it back on their ass'es.

P.s - not long ago I was struck with a shady shady police man that claimed I committed a moving violation just to find probable cause to stop me and harass about my window tint. Not knowing I have exemption this POS decided to send me to the judge and wrote me five tickets. All four of em were dismissed but the moving violation that was dropped down to a parking violation. I spent like 70 bucks and a couple of hours of my precious life.

I've forgot to write the closure.
You can always contest his word. It's going to be your word against his and you both going to trial. The lawyer should be able to get his side of the story straight and he will have to proof and provide a reference in which he recorded your speed.
When mailing your not guilty charge don't forget to request the officer deposition.

I'd see if the speed was accurate, and if it was, wonder if he didn't get a PT (and go get my install tested right away).

And they might use this discretion to “visually” ID speed once the see brakes go on hard, nose of vehicle go low, and not get a speed until the person lets off the brakes and Shazam, is at PSL. :)

It’s the same in Texas. In fact, DPS is explicitly trained to visually estimate speed and only then initiate radar or lidar to confirm. Not all are that dedicated, and of course county/city is a mixed bag.

They’re also under no obligation to record their activities or show you the radar/lidar readout if they locked it. There’s no way to “know” they did or didn’t other than their word. The one ticket I’ve actively fought (and won without a fight, luckily) was from one where a guy literally made it up (and was about 10mph high) because he was pissed I didn’t follow the bowing and scraping rule of deference to crawl along 5 lanes over while he had someone pulled over on the far right shoulder of the interstate. And he was in a ghost marked cruiser, relegated to traffic duty, not a sign of someone who’s highly regarded by his boss and satisfied with his career, so he was already a little touchy.

Hypothetical. I'm talking like you have a top tier setup and he has an old gun, guarantee jam, but you still get a ticket and he claims he got you on lidar.

True but having language prepared for such an encounter could be the difference between ticket and warning.

If jammers were legal in the state then I would be honest about them HAHAHA not. I’d indicate that I could tell there was no punch through via the tech I run. ;) /sarcasm

If jammers were illegal, I would deny speeding. I would request an accuracy check and act appalled that I was pulled over and be insistent that s/he mistook me for another vehicle.

Don't talk about jammers in illegal places.
Don't talk about jammers in legal places. The last thing you want is to make them illegal. It has happened before.

If this happens, you can never be sure if you actually jammed or not. Punch through happen.
Fight it any other way or take it for the team.

Never, never, never, ever admit to having counter measures of any kind. The only counter measure I’ve indirectly admitted to in my day Waze (not by name, but as “GPS”) became it beeps at me when going x MPH over the posted limit. I told him I couldn’t have been over by much because it hadn’t beeped at me.

YEARS ago, a buddy went to court in NY and told the judge that he does not believe that the officer used radar, as his RD did not go off... judge said we have no reason to doubt the officer's word, and that the RD has not been certified as fully working, and said, regardless, the officer is trained to visually estimate the speed which he did. When buddy then asked the officer how he could estimate the speed, and how long the car was in his field of view etc, he gave conflicting information which mathematically was not possible (he brought maps, drawings and calculations to court!) to estimate the speed. Judge hemmed and hawed and reduced the ticket to cover the court state fee costs, because buddy produced a good case, but judge was still not willing to say that officer was wrong....

Have also heard cases that should have been dismissed on legal grounds, but judge did not and just said APPEAL ME....

Your luck may vary....

I wonder if the "I don't believe the officer was using radar because my RD didn't go off" argument would work in VA :D.
