As per usual, looking for advice for friends...

The GF got a 60 in a 45 the other night coming home from work at 11pm. An RD totally couldn't prevented this, and the cost of the ticket is the cost of an RD. However, she is not in a financial position to buy an RD, meaning she is not in a financial position for the ticket.

She goes to school from 9a-2p, then work 3p-11p. She doesn't want to take off for court, and wants to just pay the ticket. I don't think she should, as this could raise her insurance costs. If she goes to court, they'd probably reduce it and make her take the class. She could also use the Prayer for Judgement, but from what I understand it's not guaranteed that the judge will grant that.

What do y'all suggest? She doesn't have the money for a lawyer

As she has already seen, when you first believe that something is unaffordable, everything you pay afterward is far, far more unaffordable. A decent radar detector now looks far more affordable than any of her court and insurance consequences in hindsight.

Whatever she does, she cannot afford to pay the ticket and move on as if this won't come back to cost her even more. As you know, it will increase her insurance rates and will impact her driving record if she ever gets pulled over again.

Sounds like she doesn't understand the consequences so that's where you can help her adjust her frame of mind that sometimes you have to spend money to save money. The Uniden DFR7/LRD950 can be picked up for $130-150 and will pay for itself with the first save. And the R1 is only $50 more.

The NC guys can tell you how court is handled and if there are other alternatives, but unless she is a glutton for punishment she's only going to make matters worse by not working out a deal with the court and not buying a radar detector immediately.

Definitly worth fighting it, sometimes you can even just call the court and they will make you an offer you can take thats reduced points... worth at least minimizing it. @Choose Life might be able to give some local advise on fighting a ticket in NC.

i would not pay it straight up. should at least be able to get the points and fine reduced by simply asking... if not, i would screw with them and plead not guilty and ask for a jury trial and have the trail rescheduled due to school and work to stretch it out. i'm batting 500 on completely getting out of tickets and a 1,000 on reductions without a lawyer .

i got out of one completely by asking for a jury and delay tactics. i got out of tickets by nicely pleading with the cop on the day of or day before court. one ticket i asked for bench trial and the judge was a college friend. so you never know....

30-90 days later you'll get letter from Raleigh Raleigh DMV suspending her license automatically for 30 days

I recommend spending $50-$75 for an attorney out of (Concord only)

Speak with them and tell them she had no prior speeding tickets and want it reduced to improper equipment
About $280 non moving no points

Tell the attorney since she has a clean record you arent interested in anything besides improper equipment so if you dont have confidence in obtaining this we can part ways amicably

Once she hires the affordable attorney
She doesnt have to show up at anymore hearings
Make that clear before payment
The attorney will NOT cost more than $75 for that ticket and should be $50 (16 or less is $50 up to 25 over is $75

Do not make the offer yourself
You may make it to the wrong DA
And guess what
Once a DA makes an offer that's your DA for the life of that ticket you cant change
Your attorney knows who will give you improper equipment and who will give you 9 over sticking her with 3 dmv points

Was it a Ka or K shot that got her?
City PD county sheriff or Trooper?

Thanks for the advice! Let me give some more detail so you can change your suggestion haha.

This is her second speeding ticket. The first one was maybe 3-4yrs ago.

Along with the ticket the another night, she got a ticket for expired tags. This is an issue we were aware of. The problem is that (long story short), the yaw sensor on the car (14 Civic) needs to be recalibrated to clear the lights off the dash to get it to pass inspection. Hadn't done that yet bc of money. She had already received a warning for the expired tag.

The office was a Kannapolis cop.

Obviously most of this could've been avoided, but hindsight 20/20. Just gotta figure out what to do from here. Thank you guys so much for all the help!

The ticket doesn't say how her speed was acquired, which I thought was kinda weird. There isn't even a place for that information to be entered.

Safe to say she'll be getting probably some Uniden DFR series detector for Valentine's Day! Haha

I'll probably get a DFR something, where she drives the cops pretty much use C/O. I think the DFR will probably be enough for her. She doesn't run quite the same speeds I do

I'll try to help her out with getting a lawyer, I also agree she'd have a better shot. Just comes down to getting her to agree

I would say not due to the lack of BSM filtering on that older unit. Try looking for a used MAX series and then if firmware not current, you can update it. Word has it they a fairly quiet with latest firmware.

No bsm filtering in one of the only areas left that runs K band
Its CO 35.5 performance is dismal and IO in bad terrain non existent
She might get a few lucky 34.7 pickups and feel like king of the world until she inevitably hits a 35.5 unit or even tough FF terrain on 34.7
Unfortunately we live in an area of the country where you need R3 or Redline performance
Hell Redlines can be driven under 2000ft here so can R3's
Anything besides extreme sensitivity you're asking for a ticket

Any recommendations for good lawyers for Cabarrus county? I can't remember the name of the guy I used a year ago, but he was Iredell anyways. She needs a good lawyer. Money isn't too much of a problem, I'm gonna help her pay. Obviously don't want to pay a load, but, want to get a good lawyer

I would actually concentrate on helping her improve her driving skills and tactics. You just don't do 60 in a 45 at night..............just as you don't do 85 in a 55 at night....(my last ticket, 07/2017), no radar detector would prevent that if they sit there and I/O. You can still get her an RD, but without improving her SA and thought process, she may end up with a 3rd ticket.

Another issue I see here is her schedule, 9 AM to 11 PM is a pretty long day, people get tired, don't pay attention etc. Driving while drowsy is about as driving under the influence.

1. I would teach her about not speeding at night, and if speeding, not 15 over, maybe 7-9 over max.

2. Does she have an iPhone or Android? A good windshield mount for the phone and use Waze. I come back from work past midnight myself and this known trap area is usually marked on Waze......

3. Teach her how to conduct herself during traffic stops: where to pull over (and where NOT), how to act, what to say and what not to say.........................

If she gets another ticket during night driving, I would seriously recommend for her to change her schedule somehow or find an alternate method of transportation. When people are tired and try to drive, they make mistakes (this is why I don't like to drive when I'm tired) and cops love picking on those mistakes.
