So you’re a resident/citizen of Canada, in a car with Canadian plates, and you got a ticket in West Virginia, right? But the Canadian license plate, Canadian driver’s license number, and date of birth were incorrectly recorded on the ticket?

What information was correctly recorded? Name and address, for example? Or was it a rental car, where the rental company would likely have all the right info? Do you ever plan to enter the US again in the future, and in particular WV?

In the end, paying an attorney to look at your case would really be the best route, as they could advise you of whether you maybe dodged a bullet or if they’ll still find and correct the error, what happens if you pay or don’t need pay, etc. The safest thing to do is pay the ticket.
How do they correct the error unless they see the DL again or have her personally appear???

I recall Junior getting a ticket for riding a MC without a MC license and the ticket listed a HONDA MC as the vehicle being "ridden." Thing is, Junior doesnt have a Honda MC, he's got a Honda car and NOT a Honda MC and they LEO (Noob) put the wong car and wrong ticket and admitted the guy he pulled over was on a bike. Dismissed BY DAD!!

Yes!

I just can't believe that it's $195 for a 4 over ticket. That's quite a pounding for 4 MPH...

The license plate was correct, but her Drivers Lic # was incorrect, and her DOB was incorrect, but not attributable to a smudge or anything, he turned an "86" into an full "88", though she didn't think it was funny when I said it would be nice if she was two years younger...

The address of the vehicle owner (me) is actually different than her address (taxes), and she didn't change her name when we married, so there are enough differences between the two parts that they wouldn't be linked together.

All that being said, i'll probably just pay it so there isn't any trouble, just wanted the feedback from the crowd here before I made any moves.

I don't understand this. A law was broken in the United States. How can a Canadian court try the case???

The USA court judge will not seek extradition over a minor misdemeanor nor want the cost associated with a transfer and dismiss it.

Usually dismissed and hence another reason for the officer to reduce the speed to improve those odds. If you live very far from the citation, attending court in that location causes extreme hardship and its not in the best intrest of justice to pursue the matter any further.

In WV up to 10 over is $5+court costs on a restricted access road (which most of US19 is - I'm guessing he was on the portion between I-77 at Beckley and where 19 meets I-79, which is Interstate quality for the majority of it.)

The court costs were $174 in Mercer County 4ish years ago (last time I got popped - 71/55 marked down to 64/55), so $200+ now (and in a different county) is probably correct.
Anecdotally, my insurance company never asked if I have any new tickets, and I didn't volunteer the information, and no rate increases happened.

+8mph is generally safe in WV. But if your cruise likes to overrun at the crest of the MANY hills, that'll get you.

The following is not to be confused with any legal advice, but solely as an anecdote of my experience.

In 2006, I was living in Raleigh, NC and traveling back to the Lexington, KY area to visit family and friends. While passing through WV, I got pulled over for doing 80 in a 65 by a WV State Police officer. NC plates on my car, ticket was for the full 15 over.

On the way back to NC, I went through TN and avoided WV. I have avoided driving in WV ever since. I never paid the ticket.

(I also received a ticket in VA for using a radar detector in 2001 - never paid that one either).

The way I see it there are 2 possibilities. They either do or do not have enough correct information to connect your wife to the ticket. If they do not have sufficient correct information, I would think that would render the ticket unenforcible. For such a minor offense why would they expend any additional effort in trying to make a connection on a flawed citation. If there is no reciprocation with Canada you could just pay the fine and be done with it. However, if there is reciprocation, any payment method which reveals your identity could get those violation points that would otherwise be "lost" connected to your wife.

Didn't want to jinx it by talking about it but didn't think laser was much of a threat around here. Just got nailed last night, he said he had me at 78 in a 65 also. Wasn't even in a real hurry, just felt like cruising, wanted to get to the store and home and make dinner. It was dark out-I know, was goona take it easy but thought there's enough cars out here I should be fine. Passport never made a peep, but there may not have been any scatter to get if he wasn't shooting every car. I was passing a car at the time I seen him in the median. Jammed the breaks, knew he would see the lights but thought I should try, but really I'm sure he had me long before I ever touched them. Didn't think he woulda been using laser. Was on the way back from the casino, won 65 bucks right away gave back 15 then hung out awhile and watched the rest of the brewer game. Had me do the field sobriety thing, blow in the thing- I was all zeros's. GOT LUCKY AND HE LET ME SLIDE WITH A WRITTEN WARNING for the speeding. I was surprised and was like still, that's usually a ticket all day. Probably out looking for drunk drivers. He said it shouldn't mess with insurance, I don't know about that but hope not. Super thankful he didn't give me the ticket, don't need my insurance going up anymore. Was going to take it easy too and kinda felt like cruising and thought I would have been fine. But yeah, I say I'm the unluckiest person there is, so thought maybe it was a sign to get a power ball ticket. Said if I got it, I'd send him a check for 5 million bucks since he was the reason I got it- I never buy them, but unfortunately was not able to do it. But yeah, I don't know about the laser thing-not a fan of it

Its not a parking ticket. Its a Moving violation. They have your license number and plate. Thats all they need. I would pay it.
I've gotten out of tickets for the following reasons:

1. Vehicle code states that issuing agency must cite the local ordinance violated on ticket. Issuing agency cited local ordinance incorrectly (i.e. it was 14.52.050(A) and they wrote 14.52.050(1) instead).

2. Vehicle code states that ticket must have last 4 digits of the VIN on it. Issuing agency didn't add them to the ticket.

It really doesn't matter if they have all of the rest of the info correct. The law states what they have to do, and if they did not do it, the ticket is invalid. Period. But, the correct course of action here isn't to just not pay, it's to challenge the ticket in court.

About halfway between wausau and wittenberg if you know where that's at. Wittenberg is east of wausau like you're going to green bay, has the casino on hwy 45 there. Seen in another post you're down by the dells? Don't really have the funds for it now but would be cool to get some more active countermesures and test them

Yeah, been thinking about it. Didn't think it was necessary until now. I don't know, they're not cheap and sure the install isn't cheap either. Suppose could try to do it yourself but I don't know if I trust myself. How much of a beast is it to switch them out when you get a new car? This is my daily driver not a collector I'll have forever and plan on keeping it for awhile- I like it but who knows

Yeah, who knows. He said I was decent and cooperative. I've been trying to be good. I never got warnings back in the day. Got pulled over last christmas weekend on the way to work in the dark and the highway was dead and he let me slide with a $10 no prrof of insurance.

I'm pretty sure they're legal in wi, but not neighboring states, hardly ever go over there anyway. I don't know jamming's different than just detecting. Saw someone else post about when they're behind you and see the sensors. Not looking to make enemies out there either. And even if you kill it in 4 sec's do they still know you're doing it with the delay in their reading?
