well, it finally happened, 5 over..

    So, pretty much as the tittle says. it finally happened, i got a ticket... for 5 over! :bang:

    Left my house saturday to go get something to eat, a block away i take a left turn into a 35mph road, completely deserted, i blip the accelerator (probably hit 50, although have my doubts), and then reduce my speed as i was going to do a right turn, the minute i do a right turn, i see a cop with it's lights on going the wrong way down the road heading to me, as soon as i do the turn he pulls me over.

    Do you know why i pulled you over? No officer.
    You were speeding. you were doing 54, it's a 35 back there - No comment.

    At this points he asks for my license, goes back to his car, takes about 5 mins, returns and gives me the ticket "best i can do is 5 over he says" (thanks?) and then leaves without saying a thing.

    I later checked the dashcam recording and i saw him sitting at a parking lot entrance at a 90 degree angle from the road, so no way it was radar. could've been laser, but not even sure these guys have laser (was local pd, not sheriff), no beep from rd. to be honest, i think he just eyeballed it, i was the only car on the road at the time.

    this is my first ticket ever, so i intend to fight. no way i'm getting points for this

    does it say anything on the ticket about how speed was measured? they often do... if not, its a piece of information you can get during discovery portion of the legal proceedings also did he note on the ticket anywhere your actual speed (or did he just put 5 over)?

    No notes on actual speed, cited speed "40mph" posted speed "35mph". No notes on how speed was measured either.

    will 5 over go on your licence? if they wont, didnt he give you a break, if you were speeding?

    In MN all go to the license, fine differs depending on speed, no point system in Minnesota, so insurance % increase is left to each company

    Speeding 1 to 10 mph over limit 120.00
    Speeding 11 to 14 mph over limit 130.00
    Speeding 15 to 19 mph over limit 140.00
    Speeding 20 to 25 mph 220.00
    Speeding 26 to 30 mph 280.00
    Speeding 31 mph or more 380.00

    Special case when it's over 100mph, which is then considered a misdemeanor, with $1000 fine, lose license and 90 day jail time as well.

    GPS on your dashcam? Able to calculate how fast you were going when he had line of sight?

    I'm still kinda surprised they would even look at tickets written as 5 over, down here, if you get a ticket for 5 over the judge will usually just toss it, cause 5 over is debatable based on speedometer tolerance and measurement tolerance on the radar/lidar guns. heck based on how I'm sitting in my seat I can get near 5 mph reading error just by changing the angle at which I look at the gauge... Fight it for sure and see if you can get it to go away altogether...

    worst case senerio can you get a diversion? speeding tickets are really hard to beat, imo... that does bite it goes against your D.L.

    Well since you said you were going 50-ish, and then the cop even tells you he clocked you at 54--Im sure he used Laser!! Most RD's dont even go off with a laser shot, unless direct hit almost (except V-1) which is really good but still would not have saved you! Time for ALP

    @Holla seriously, ONLY the V1 goes off on lidar?? Really?? Almost 7 years on here my friend and ONLY the V1 goes off to lidar??

    What I meant was the V-1 is one of the best to catch a Lidar hit---Yea they ALL will at some point

    while the R3's aren't amazing on laser, they do indeed still go off to it if at a far enough distance... close shots are potentially a miss though. I found when testing my ALP's that the R1 would go off solidly from 2000 ft down to about 500-700 (against the TSS) feet then it would usually lose the signal and stop alerting. OP could also have encountered a unicorn, how do you have the R3 setup? perhaps the leo was firing something out of tune or something in a range you aren't scanning? be interesting if you are fighting this to see what they got you with if you get additional info during discovery.

    @marcoaml78 Make sure the Radar (or lidar) unit was checked the day you got the ticket (before shift started) and that it was verified to be working. They must have a log or some other evidence that he checked it at start of shift. Honestly, most guys say they do BUT they don't .

    EH, I beg to diagree, BUT don't want to throw this thread off track here. The 5 sensor on the Redline and /or Magnum do every bit as well as the V1 on off axis lidar hits.

    BUT, this may be an interesting ticket because the R3 is super quick on IO shots and unless he missed the shot, then it could have been 1. eyeball call or 2. lidar Need to see the ticket and or the video too.

    Yea, I probably put myself in a corner saying that lol---Most detectors do pretty good, but I think we agree the V-1 is one of the best with Lidar :)

    Me no agree. If he had tagged @marcoamI78 at 54 in a 35 with laser, a donut-eating revenue generator would have written him up for 49 in a 35. Citing him for 5mph over the limit screams (and smells) BS. The LEO is probably hoping Marco just pays the ticket and goes away.

    I don't know how it works in your state. It is possible if you fight the 5 over he can put the 19 over back on the table. Was the original speed noted on the ticket?
