Gotta be more careful

    Ticket Issued: 9/8/17
    I have to respond to court (mail in the ticket): 10/30/2017

    When I request support deposition, do I have to do it within 30 days of when they issued me the ticket? Or within 30 days of 10/30/17?

    If I am reading this correctly, I have to wait until at least October 1 to mail it in? Is this a trick they like to do?

    Request the long form written supporting deposition, on the citation itself (you have to write that yourself in the blank box), make a copy of the citation with the request, and send (original) to the court certified mail ASAP.

    I think state law in NY is that your supposed to move over for emergency vehicles if they are stopped on the shoulder if it is safe to do so. If not I would assume you have to slow down. There's a lot of mediocre state laws out there and they could use any of them to their advantage to pull you over. Another one is wipers and headlights are required to be on when raining and so on. Basically common sense stuff. Do they enforce it on a regular basis? No. When do they enforce it? When they want to pull you over.

    Update: just 20 days later (they like to hit the beginning of the month and end of the month) my boy was back at it again. I was leading the target car group (image attached). This time I drove exactly 30 (which no one ever does) and I saved the 6 cars behind me (no one had the balls to pass me and it was a good thing today). LEOs face was priceless. Wondering what is going on. They always are out there on Friday mornings and only Friday mornings.

    Its really a disgusting trap.

    Went to court on Monday. Placed was a zoo. Standing room only. Prosecutor was pulling names out of a shoebox filled with tickets and "giving deals". Most people were there for speeding as my local Leo's used LIDAR in 30 mph zones to generate revenue. Everyone got a 1201A (also known as parking ticket). It was so busy the prosecutor and judge didn't really care what your ticket was for, unless you had multiple tickets or were there for something else. It was straight plug and chug. When the prosecutor called my name he already was writing out the plea for 1201A. I had to stop him and say, excuse me sir but I would like to motion to the court to dismiss this ticket as no supporting deposition was provided. He stopped writing, looked right up at me and asked me if I was an attorney. I laughed and said no. He then crossed off the plea and wrote dismissed.

    I went back out to the court where the judge dismissed the ticket.

    I walked out without paying anything or pleading guilty to anything!

    That's how you handle a BS ticket.

    Shame you can’t prosecute the revenue agent (LEO) for abuse of process, malicious prosecution, perjury (his sworn allegation regarding the traffic light was provably false), etc. maybe you should collect a fine and costs. That would be justice!

    I believe that in NYC its illegal to cut thru a "Parking Lot" or "gas station" to avoid a light. Its up to the discretion of the LEO. I never cut thru lots. If i go through a lot I park and go to the store or gas station, never will I cut thru a lot strategically to get out of waiting for a light or to make it easy. I wouldn't never take that chance its not legal and is looking for trouble. You don't do things to 'look for trouble' you do stuff to avoid trouble.

    Been there done that! BUT, on the other hand I witnessed a local judge turn around to the officer and say, please write out a supporting deposition.... When guy quoted the law and said that it is too late and it would not remedy the case, judge looked and him and said: APPEAL ME. GUILTY!

    Local rookie started doing that to locals here. Complaints to other cops (who dont ticket that) were answered, he's new here, give him a few months and he'll stop.

    Yes. That law applies to NYS. It is not specific to NYC. I call it a cut through, but it's a road. You can see it on the map provided in the thread. It's not like we're actually cutting through a parking lot or something. We're using side roads to get to highway faster in the wee hours of the morning. Nothin illegal about that.
