I was involved in a fender bender last month and it was caught on my dashcam. We called the police and got a police report but the police were fools and wrote my statement incorrectly. Obviously, the other driver lied because she didn't want to pay for the damage so the insurance company was saying I would be the majority at fault. After I sent them my dashcam video, they agreed the other driver is 100% at fault. Initial repair estimates at the adjuster's office was a measly $1,000. Went to a certified BMW Collision Center (BMW Freeport) and the claim got increased to $4,077. I think they did a great job and I got to drive a minivan rental for 2 weeks. Feels good to be back in my own vehicle along with CMs again.

Moral of the story: police are fools and have dashcam(s) in car.

My wife was rear-ended while stopped at a traffic light (Catskill) about 12 yrs ago. Her car was totaled. Trunk was pushed up against the rear windscreen, and she was pushed into the car in front of her, which was pushed into the car in front of them. New, rookie, female cop came out, and told my wife that she was 100% responsible for everything. My wife (nicely) told her she was full of it, and was told "Well, you need to be prepared for anything" We had to go to the cop shop and argue with supervisors, who initially didn't want to change the report, even though the driver who rear-ended her admitted fault. Eventually, after threatening legal action against the Catskill PD, they relented and re wrote the report correctly.

Epilogue: 6 months later, the same female cop got T-boned (in patrol car) by someone running the same light. Patrol car was totaled, and cop went to Albany Medical Center for a week or two.

No Fault ONLY relates to Med pay and Bodily Injury claims and has nothing to do with Comp and Collision claims for damage to the vehicle or property.


"Currently 12 states and Puerto Rico have no-fault auto insurance laws. Florida, Michigan, New Jersey, New York and Pennsylvania have verbal thresholds. The other seven states—Hawaii, Kansas, Kentucky, Massachusetts, Minnesota, North Dakota and Utah—use a monetary threshold. Three states have a "choice" no-fault law. In New Jersey, Pennsylvania and Kentucky, motorists may reject the lawsuit threshold and retain the right to sue for any auto-related injury." (Source: III)

How the heck could an adjuster EVER conclude that it was your fault?? # 1 you weren't moving #2 the picts are clear even if you didn't have a vid

What did the Accord driver try to argue, that you backed into them from your position. If that was the case, the damage would also have been different?? (from front to rear, not rear to front)? :confused:

WOW... Thank goodness you were running a two channel setup! Do you mind if I use this clip in some videos to illustrate the benefits of having a rear cam?

On a related note, this is why I feel uncomfortable whenever I'm driving without a dashcam rolling and why I like to keep spare memory cards in my glove box in case I take mine home and forget to bring it back the next time I hop in the car. You never know when you'll need it...

No fault only applies to the first $50K medical expenses
In Florida you have to allege serious or significant injury or scarring to get OUT of no fault and into regular civil liability. Very few states have no fault anymore as teh BAR is trying to get rid of it. Michigan and NY and FL still have it. FL is a PIP state and has a verbal (non-monetary ) threshold. The verbal part is the serious or significant injury or scarring which is what a doctor says it is.

Yes, she was very apologetic when this initially happened and then when the police came, she told the cop's partner that I backed into her and the police also wrote that I said I backed into her... I guess she was on the phone with someone and they told her to say that since it took the cops 1 hour to get to the scene.

I don't want to take this off topic, BUT NO Fault has been one of the biggest debacles in the civil litigation business ever. Clinics and doctors have all sprung UP to say that (in FL, for example) Mr. X was seriously or significantly injured by Mrs. Y and they milk the Med Pay or PIP benefits on their own policy to the point that the bills are so HIGH that the person "MUST" be injured because there's so many bills and treatments. The original intent 35 years ago has been bastardized so that many sharp lawyers and clients figure OUT how to take their case OUT of NO Fault and into the regular tort system. It can be done with monetary thresholds (Cost of treatment $$) or verbal ("I'm injured and can't get up or work." ) . Typically, insurance rates in No Fault states are significantly higher than those with the traditional tort based system. Michigan rates can be 30-50% higher than IL just because of this, yet IL has many more accidents and higher populace.

Audio caught on dashcam or phone recording? Could cause some hotter water for her and/or her insurance agents when she was shown to be lying to police.

i had that accord, it is a lot more wide than you expect, that car drives big. she thought she was clear of your car and made the idiot move. people don't realize the lies they use to protect themselves screw the innocent, then it becomes fudged up

I guess I'm not very bright because it was completely obvious that it was the other person's fault. Can't believe they even argued with you and tried to get out of it. What a joke. Thank God you had it on camera.

When that lady hit me in August, I was between dash cams. That accident expedited the next cam purchase. Made sure it was F/R recording.

I guess I'm not very bright because it was completely obvious that it was the other person's fault. Can't believe they even argued with you and tried to get out of it. What a joke. Thank God you had it on camera.
She said I was backing out of the parking lot and she's suppose to have right of way which caused me to back into her and that is what the police wrote. I didn't check for the audio but there wasn't really any harm done so I wouldn't pursue the false police report. Thankfully the important part was captured and I'm sure she'll see a nice insurance premium increase.

At first, she was clear. Then I think it was the Lexus on the opposite lane that was coming at her, she turned back right to avoid hitting him but hit me instead.
